INFORMATION

The société anonyme “Aegean Motorway, Concession Company for PATHE Motorway Maliakos – Kleidi section”, (the “Company”) makes available to its subscribers (the “Subscribers”) a new upgraded service (hereinafter “the Service”) that provides online information regarding their “eway” subscription account and access to monthly invoices; the service also allows subscribers to submit requests to Customer Service, to manage their data in relation to their “eway” subscription account and to get itemized monthly statements of their transactions at the toll stations of the Maliakos – Kleidi section of the Patras-Athens-Thessaloniki (PATHE) Motorway. For any query, clarification or communication regarding the Service, the Subscriber can contact the Customer Service Department by phone (hereinafter “Customer Service” – T: 2414 401010), by email to customercare@aegeanmotorway.gr, by letter to Aegean Motorway, Customer Service, Moschochori, 415 00, Larissa, or to visit us in person at any of the Customer Service Points (hereinafter “the CSP”) operating at the locations listed here.

ARTICLE 1: Use of the Service

1.1. Access by the subscriber (or by a third party especially authorized by the Subscriber for this purpose) to the account content and the itemized transactions statement is provided via the “My eway” portal of the Company’s official website www.myeway.gr.

1.2. To activate the Service, the Subscriber first enters the eight-digit customer code (found on the upper right hand side of the Application – Contract that the customer signed when they subscribed to a program) and their VAT number. The Subscriber must then choose a username and a password. Account activation also requires that the Subscriber fills in their email address – please note that this should be the same email address that the Subscriber had given to Customer Service either when they first subscribed to any program or even at a later date, but in any case before registering for the Service. Once all data have been entered in to the “My e way – Activation” platform, the Subscriber receives an email confirming that he has successfully registered to the service.

1.3. Once the Service is activated in line with the procedure described in article 1.2 above, Subscribers can access their account by filling in only their username and Password (as these were set in line with article 1.2). Please note that username και passwords are strictly personal and that they are not recorded or saved when the users type them in the platform. The Company has no responsibility for the loss or disclosure of the access codes by the Subscriber or the illegal use thereof by any third parties. Once registration to the Service is completed, Subscribers can access their account and the itemized statements on a 24/7 basis via any computer with a connection to the internet.

1.4 The Service allows access to statements for the current month (in PDF format) and the twenty four (24) previous calendar months for which an invoice and itemized statement has been issued for the particular customer code. If the Subscriber wishes to keep a record of transactions over a period of time longer than the one currently offered by the Service, they must do so by their own means.

1.5. The right to access the Service is valid for as long as the Subscriber’s account is active or until their subscription is cancelled following the Subscriber’s request to this effect, or following the Company’s decision to terminate the Service. If the Subscriber wishes to keep a record of transactions over a period of time longer than the one currently offered by the Service, they must do so by their own means.

1.6. Registration and access to the Service is free of charge (apart from any applicable network charges payable to the Subscriber’s internet provider). The Subscriber may open one account per eway customer code irrespective of the number of transponders that are registered under this code; statements are itemized per transponder. If the Subscriber has more than one customer codes, the registration process must be repeated for each code separately (for Subscribers that wish to open accounts for their different customer codes).

1.7. The Company maintains the right not to offer the Service or to temporarily suspend the Service for reasons pertaining to transactions safety, safety of the user/ subscriber or the company itself, or for maintenance/ upgrade reasons. Temporary suspension of the Service by the Company may occur at any point, as the Company sees appropriate, without the Company having to announce to the user/subscriber the reason for the suspension. However, the Company must inform the user/subscriber of the fact that the Service and/ or certain secondary functions have been suspended.

ARTICLE 2: Change in the email address

2.1. In case of a change in the email address that the Service has in record for the Subscriber, the latter must notify the Service of this change by email, or by submitting a request in writing by contacting the Customer Service (T: 2414 401010) or in person at a Customer Service Point. The Company shall process the request within two (2) business days from the date this is made.

2.2. In case the Subscriber does not proceed to this notification, their account and detailed statements of transactions will continue to be available via the “My eway” platform.

2.3. The Company may use the email provided by the Subscriber to contact him, to inform him of any similar products or services and/ or to inform him of any new products and services based on the provisions of L. 3471/2006. At any time, the Subscriber may request that the Company stops using the email provided for promotion purposes or for notification of new products/ services.

ARTICLE 3: Cancellation of the Service

3.1. The Subscriber that has registered for the Service may cancel his/ her account with the Service at any time by clicking on the “cancel my account” button, effective immediately.

3.2. The Service may be cancelled by the Company for any reason (technical, force majeure etc) without any prior notice.

ARTICLE 4: Data Protection

4.1. The purpose of the Service is to provide online information to the Subscriber/ user of the Service regarding the monthly itemized statements of transactions made using their e way transponders. The Subscriber states that he/she has given his/her express consent regarding the use of the Service as per the provisions of articles 5 and 11 of L. 3471/2006 (Protection of Personal Data and Privacy in the electronic communications sector and Amendment of L. 2472/1997), that they have the exclusive use of the email address it has registered for the Service and in any case, that he/she is exclusively responsible for any transfer, notification or notice to person(s) or by person(s) in his/ her sphere of influence of personal data

handled via the “My eway” platform within the framework of providing online information regarding his/her accounts. The Company is not responsible vis-à-vis the Subscriber/ user of the Service and/ or any third party before any court as regards claims or other demands or conflicts for acts of omissions of the Subscriber or his/her personnel or in general, by any person connected with the Subscriber via any degree of relation, power of representation etc, which acts/ omissions had as a result a result the access to, processing, management, use etc of data contained in the platform by any persons not authorized to view such data or by any unauthorized use of the Subscriber’s username and password. The Subscriber/ user of the Service has the right to be informed and to access the data that the company keeps and processes for them and to file an objection against such processing in line with art 11, 12 and 13 of L. 2472/1997 (Protection of a person against the processing of data regarding their person), as amended and in force. 4.2. The Company shall keep a record of and shall process the personal data of its Subscribers with the purpose of upgrading and improving the Service.

4.3. The Company states that it keeps and processes personal data for the purposes of issuing the invoices only; no personal data will be shared with third parties unless it is in compliance with the law and under the conditions specified therein.

4.4. The Company is not responsible for any breach in confidentiality by the Subscriber or by persons connected with the Subscriber by any degree of relation (relative, representative etc), which would have as a result the access to, processing, management, use etc of data contained in the platform by any persons not authorized to view such data or by any unauthorized use of the Subscriber’s username and password.

ARTICLE 5: COOKIES

5.1 The present website uses technologies such as cookies to collect non private recognition data for its users from the interaction between the web browser with the server. Cookies are short text files that are stored at the customer’s/ visitor’s hard drive; cookies do not gain access to any documents or files stored in the computer – neither do they identify use of the computer with any particular person. These files are used for the improvement of the use of the website, the facilitation of access to the website for its users/ visitors as regards particular services and/ or web pages for statistical reasons and in order for the company to identify the functions that are useful or popular.

5.2 Subscribers using this website can check the settings of their web browser which must be set not allow unconditional acceptance of cookies and instead to request user’s permission for the installation of cookies. It is pointed out that if the subscriber/ visitor has de-activated acceptance of cookies, they may have restricted access to some of the services or functions provided by this website. It could be useful for subscribers/ visitors to install an add-on or plug-in to manage cookies, available via their web browser, so that they can have better control over when these are installed in their computer.

ARTICLE 6: General Terms of Use – Limitation of Liability

6.1. Registering and use of the Service signifies the express and unreserved acceptance of all the Terms of Use thereof.

6.2. Passwords are personal, not transferable and should not be shared with third parties. Their notification by the Subscriber is always made at their personal and exclusive risk. In case the Subscriber forgets their password, they may use the “Did you forget your password” option in order for the system to email a new password to the email address they registered with and then to follow the procedure of par 1.3 of art 1.

6.3. The printout of the account and the detailed statement of transactions constitute formal tax records and can replace any other information documentation dispatched. The Subscriber (or any third party with authorized access to the registered email) does not have the right to alter or change in any way the data contained in the account and the itemized statement of transactions.
6.4. The information, data and material included in this unit are the property of the Company and are subject to changes at the discretion without any prior notice to the Subscribers.

6.5. All terms are material. Any breach by the Subscriber gives the Company the right to suspend or terminate the Service following prior notice to the Subscriber to this effect. Non exercise by the Company of its rights cannot be interpreted as a waiver of its rights.

6.6. The Company makes all effort necessary to ensure the safety, accuracy and thoroughness of the files contained in this unit but cannot be held responsible for damages of any kind resulting (indicatively and not restrictively) any errors, omissions, termination, fault in the system or the connection, computer viruses, wrongly stated data, loss of content and/ or delay in the loading of the Service due to technical reasons or due to the upgrading of the system or due to force majeure events.

6.7. The speed of loading of the online account content and the itemized statement of transactions (in PDF) depends on the network traffic (for the network provided by the Subscriber’s internet provider) at the particular point in time and also on the connection line (ADSL or other). The Company is not responsible – nor does it guarantee – the availability of other network providers to which the Subscribers are connected.

6.8 All electronic services are available on a 24/7 basis via any computer with access to the internet.

6.9 The minimum technical requirements for accessing the service: XP 7 or most recent operational system, Internet Explorer 11 web browser or the more upgraded versions, Firefox, Chrome.
